So you’re a Scottish Company with English Debts
Many clients, based in Scotland, and supplying goods or services to English customers are able to raise court action in their local Scottish Sheriff Court to recover their cash, rather than going to the trouble and expense of starting proceedings in England. There are enormous advantages in using the Scottish Courts:
- In our experience English debtors are far more responsive to a Scottish court action coming from a Scottish Lawyer. Recovery rates are far higher than if you start the action in England.
- If the case is disputed the debtor has to come to your court rather than you having to travel to your customers English County Court, which can be as far away as Penzance!
- If payment is not made in response to our Scottish decree we are able to enforce the Scottish Judgment in England. We do this by transferring the decree to our English Enforcement agents and they immediately get the benefit of enforcement by an experienced High Court Enforcement Officer rather than very time consuming English County Court Bailiff enforcement, which you may have to use if the court action was started in England.
- If the court action is initiated in Scotland, all Scottish decrees transferred to England will get the benefit of being enforced with a High Court Enforcement Officer.
Costs
Yuill & Kyle charges will be the same as they would be for raising court action against a Scottish debtor. This would be £47 - £75 + vat, plus any judicial expenses and disbursements which would be recoverable from the debtor. In addition to this, our English agents would charge a total of £124, plus any Sheriff fees, which vary on a case by case basis.
